カリフォルニア州・同性結婚を禁止する修正法律は違憲!

やりました~。一旦、合法化されたカリフォルニア州の同性結婚が、前回の州民投票(通称Prop 8)で一転、禁止とする修正法案が通過してた。今度は、連邦裁判所が、その州民投票の結果を違憲とする判決を下しました!これにより、再びカリフォルニア州で同性結婚できる法律が有効になる(気配)。まだ、同性結婚に反対する市民たちが控訴するらしく、予断を許さない状況だけど、とりあえず2勝1敗になったぞ。

だけど、連邦裁判所(国の最高裁の判事)の一人が、同性結婚を禁止するカリフォルニアの修正法案を違憲としたことにより、今後、連邦法における同性結婚の取り扱いはどうなっていくんだろう?だって、連邦裁判所の判事が、同性結婚は合憲、という判断を下したわけで、じゃー、連邦法でも同性結婚は合法ってことになっていかない??今後の行方から目が話せません。

Judge Vaughn R. Walker's conclusion, page 135:

「法律修正案第8条は、ゲイ男性およびレズビアンたちのみを限定して結婚許可証(の付与)を拒否するということに関し、いかなる合理的根拠を提示することに失敗している。実際、証拠が示すのは、修正案第8条が、カリフォルニア州憲法において異性カップルが同性カップルよりも優越であるという考えを法制化する以上のことは行っていないということである。カリフォルニア州は、ゲイ男性およびレズビアンを差別する行為に何の利益も関心も持たないため、そして修正案第8条は、カリフォルニア州がその憲法で定められた、平等に婚姻を認めるという義務を履行することを妨害するため、裁判所は修正案第8条を違憲であると結論付ける」

"Proposition 8 fails to advance any rational basis in singling out gay men and lesbians for denial of a marriage license. Indeed, the evidence shows Proposition 8 does nothing more than enshrine in the California Constitution the notion that opposite sex couples are superior to same-sex couples. Because California has no interest in discriminating against gay men and lesbians, and because Proposition 8 prevents California from fulfilling its constitutional obligation to provide marriages on an equal basis, the court concludes that Proposition 8 is unconstitutional.

修正案第8条を撤廃することに関して(136ページ)
On the overturning of Proposition 8, page 136:

「原告は、修正案第8条が〔国民の権利としての法の)適正手続き及び平等な保護を受ける権利を侵害するということ、そして州当局が修正案第8条の強制施行を停止しなければ、これら違憲行為によって彼らが害を被り続けるという確かな証拠をもって論証した。カリフォルニア州は、同性カップルに対して結婚許可証を発行することが可能であり、それは(カリフォルニア州当局が)既に1万8,000件の結婚許可証を同性カップルに発行していながら、その結果、なんら実証された被害は発生していない...」
"Plaintiffs have demonstrated by overwhelming evidence that Proposition 8 violates their due process and equal protection rights and that they will continue to suffer these constitutional violations until state officials cease enforcement of Proposition 8. California is able to issue marriage licenses to same-sex couples, as it has already issued 18,000 marriage licenses to same sex couples and has not suffered any demonstrated harm as a result ...

On why voters are not able to ban gay marriage in California, page 24: [Updated, 2:51 p.m.]

〔問題を引き起こす出来事や状況などの〕組み合わせ、憶測、恐怖というものは十分(な理由)ではない。ある集団または市民グループが道徳的に不同意するということは、いかに大多数派がその考え方を共有していても、依然として十分ではない。厳粛に考慮しても、修正案第8条がそのような不支持層の間においてのみ支援されていることは、証拠が明らかにしている。よって、修正案第8条は、有権者またはその代表(議員)が持つ憲法上の権利を超えたものである。
Conjecture, speculation and fears are not enough. Still less will the moral disapprobation of a group or class of citizens suffice, no matter how large the majority that shares that view. The evidence demonstrated beyond serious reckoning that Proposition 8 finds support only in such disapproval. As such, Proposition 8 is beyond the constitutional reach of the voters or their representatives.
